Failure to do so, or if the card is damaged, will result in a $25 charge to replace the card.Waiver of Rights and Subrogation Clause* I have read, I understand, and I accept the below Waiver of Rights and Subrogation Clause I hereby waive all rights and/or subrogation rights to claim, sue or take legal action against the Peachland Yacht Club and hereby release the Peachland Yacht Club from all liability, and specifically but without limitation, from any claim for loss or damage by fire and any other hazards or caused by any act or neglect on the part of the Peachland Yacht Club or its employees, officers or members.Rules and Regulations* I have read and acknowledge agreement with our Rules and Regulations Only PYC Members or approved guests using the reciprocal moorage facilities (“Guests”) with a valid Pleasure Craft Operator Card may operate a boat within the Marina. Operating a boat while impaired or operating a boat in a dangerous manner may, at the sole discretion of the Directors of the PYC, result in the Guest who owns such boat being immediately denied the privilege of mooring at the PYC. All boats under way within the breakwater shall proceed dead slow and in a cautious and seaman-like manner to avoid damage to other craft. Guests are responsible for any damage caused by their wash. Outbound vessels shall have the right of way over all other craft at the Marina entrance channel. Pouring of fuel within the Marina is strictly prohibited and will result in immediate loss of moorage. Storage of flammable liquids must be in approved containers. Electricity is provided strictly for low-demand purposes such as battery chargers. Electricity is not permitted to be used for air conditioners. If a boat is equipped with thru-transom exhaust operation, its use is prohibited while the boat is operating inside and in close proximity to the Marina. Boats equipped with thru-transom exhaust must have a ”Captain’s Call/Silent Choice” switch. Engine noise muffling equipment must be in use at all times during operation inside and in close proximity to the Marina. Smoking (including vaping) within the confines of the Marina is strictly prohibited. Minor repairs only may be carried out in the Marina. If a Guest requires more significant repairs while mooring at the Marina, the Guest shall make arrangements with an officer of the PYC to have such work completed. Guests must not moor or secure any boat or structure to any part of the Marina (including land and improvements) for use as a live-aboard facility, whether permanent or temporary. The anchoring of any vessel within the Marina or fastening of any vessel to the breakwaters is strictly prohibited. There shall be no swimming, diving, paddle-boarding, fishing or waterskiing in the Marina or in the approach channel to the Marina. No tires, bumpers or other materials may be fastened to the docks by a Guest. Storage of personal property or boat equipment outside the confines of the Guest’s boat is prohibited. Water toys, dinghies, etc. must be stored on or in Guests’ boats and not in the water or on the docks. Children under the age of fourteen (14) years shall be accompanied by an adult while on the Marina premises. All litter and rubbish of a Guest or of their guests must be removed by the Guest. No litter shall be thrown overboard or left on the floats. Pets must be kept on a leash and in the hands of a competent person at all times.
